What your DMCA notice must include
Per the DMCA, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed (e.g., specific song title, songwriter, publisher, registration number if applicable).
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it (provide the full URL or URLs on mylyricsfinder.com).
- Your contact information: full name, mailing address, telephone number, and email.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Our response
- We acknowledge receipt within 24 business hours.
- We action verified, complete notices within 48 hours of receipt. Action typically means removing the lyric content from the affected song page(s); the editorial interpretation usually remains as it is independent original work commenting on the song.
- We log every notice and the action taken.
- We notify the alleged infringer (if applicable) and provide them an opportunity to file a counter-notice.
- If a notice is incomplete or appears to be made in bad faith, we will respond explaining what is missing or why we cannot action it.
Counter-notice
If you believe content was removed by mistake or misidentification, you may file a counter-notice under 17 U.S.C. §512(g) by sending an email to the agent above that includes:
- Your physical or electronic signature.
- Identification of the material that has been removed and its location before removal.
- A statement, under penalty of perjury, of good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., the judicial district where MyLyricsFinder operates), and that you will accept service of process from the original complainant or their agent.
On receipt of a valid counter-notice, we will forward it to the original complainant and inform them the material may be restored after 10 business days unless they file a court action.
Repeat infringers
Per 17 U.S.C. §512(i), we have adopted a policy of terminating user accounts that are determined to be repeat infringers, in appropriate circumstances.
Misuse
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. Please file notices only for content you have a good-faith belief infringes your copyright.
